BernatCares Charity Yarn Draw Official Rules, Terms and Conditions

ELIGIBILITY:

• All bona fide religious, charitable, labor, business, fraternal, educational or veterans’ organizations that operate without profit to their members (referred to in these Rules as “Charitable Organizations”) and have registered on Bernatcares.com that have acknowledged that they would like to be entered in the monthly draw.
• NO PURCHASE NECESSARY. A purchase does not increase your chances of winning. Open to Charitable Organizations in the United States (excluding Puerto Rico and Rhode Island) or Canada (excluding Quebec) that are registered on Bernatcares.com.
• Void wherever restricted, taxed or prohibited by law.
• Bernat and its affiliates, parent companies, and agencies are not responsible for failure of Bernat to receive entries due to inaccurate transmission, technical problems, or traffic congestion on the internet and/or website. Bernat reserves the right, in its sole discretion, to cancel the Sweepstakes in its entirety if it becomes technically corrupted or because of non-authorized human intervention. In such an event, Bernat will select winners from all eligible entries prior to exercising its rights to suspend or cancel the Sweepstakes and will post notification of cancellation of the Sweepstakes on www.bernatcares.com.

TO ENTER:

• There are two ways to enter:
• (1) Online: Register your Charitable Organization with Bernatcares.com and check the “Enter us in the Monthly Bernatcares Charity Yarn Draw” box (all charities registered by the 15th of a month will be eligible for the draw to be held on the first business day of the following month).
• (2) By U.S. Mail: Hand-print your Charitable Organization’s complete name, address (including ZIP Code), phone and email address (optional) on a plain 3"x5" paper and mail it in a hand-addressed #10 envelope with first class postage affixed, to: ATTN: Charity Yarn Draw, 2700 Dufferin St. Unit # 90, Toronto, Ontario, Canada, M6B 4J3. Upon receipt of your mailin entry, you will be automatically entered in the sweepstakes. Entries must be postmarked by the 15th of each month in order to be eligible for that month’s drawing. Mechanically produced entries are not eligible and only one mail-in entry per Charitable Organization will be allowed.
• For purposes of these Rules, the following definitions apply. Non-profit: An organization or institution organized and conducted on a not-for-profit basis with no personal profit inuring to any one as a result of the operation. Charitable: an organization or institution organized and operated to benefit an indefinite number of the public. The service rendered to those eligible for benefits must also confer some benefit on the public. Educations: an  organization or institution organized and operated to provide systematic instruction in useful branches of learning by methods common to schools and institutions of learning which compare favorably in their scope and intensity with the course of study presented in tax-supported schools. Religious: any church, congregation, society, or organization founded for the purposed of religious worship. Fraternal: an organization of persons having a common interest, the primary interest of which is to both promote the welfare of its members and to provide assistance to the general public in such a way as to lessen the burdens of government by caring for those that otherwise would be cared for by the
  government. Veterans: an organization or association comprise of members of which substantially all are individuals who are veterans or spouses, widow, or widowers of veterans, the primary purpose of which is to promote the welfare of its members and to provide assistance to the general public in such a way as to confer a public benefit. Labor: an organization composed of workers organized with the objective of
  betterment of the conditions of those engaged in such pursuit and the development of a higher degree of efficiency in their respective occupations.

NOTIFICATION OF WINNER

The contest winner will be selected by random draw by Bernat from all eligible charities registered on Bernatcares.com on the first business day of each month (commencing December 1, 2010 and ending November 1, 2011).

• Bernat will notify winner by email or phone. Bernat is not responsible for late, lost, or misdirected notification. E-mail or phone notifications do not constitute a guarantee of a prize of any kind.
• Potential winner will be required to fill out and return an Affidavit of Eligibility, Release of Liability, and (where not prohibited by law) a Release of Publicity prior to the awarding of any prize.
• If the winner is a Canadian charitable organization, a mathematical skill testing question will be administered and must be correctly answered before an entrant is declared to be a winner.
• Prizes will be mailed within sixty (60) business days after receiving necessary information and, where not prohibited, an executed Affidavit of Eligibility, Release of Liability and Publicity Release from the winner.
• All federal, state, provincial and/or local taxes/duties are the sole responsibility of the winner.
• One (1) draw prize will be awarded to a single winner each month. The odds of winning depend on the number of eligible charities registered.
• Draw prize: The winner will be asked to select a type of yarn from all available yarns listed on www.bernat.com (e.g. baby yarn). They will then be shipped the selection of yarn (in the color(s) of their choice). The approximate retail value of the prize is Cdn. 0. No cash or other substitution or transfer of prizes permitted, except that Bernat reserves the right to substitute a prize of equal or greater value due to prize unavailability due to circumstances beyond its control.

RELEASE OF LIABILITY/PUBLICITY:

The entrant consents to the use of their organization’s name for publicity or advertising purposes without further compensation or notice where permitted by law. All entrants release Bernat and its partners, affiliates, subsidiaries, officers, directors, shareholders, agents, employees and all others associated with the development and execution of this draw from any and all liability with respect to, or in any way arising from, this draw and/or acceptance or use of the prize, including liability for personal injury, damages, death or monetary loss. By submitting an entry, entrant warrants and represents that entry does not violate any law, regulation or any right of any third party. Bernat reserves the right to deem an entry ineligible for this contest for any reason.

Bernat is not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, e-mail, players, or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing. Bernat is not responsible for any injury or damage to entrant or to any computer related to or resulting from
participating or downloading materials in this contest. Entrant assumes liability for injuries caused or claimed to be caused by participating in the contest, or by the acceptance, possession, use of, or failure to receive any prize. Bernat assumes no responsibility or liability in the event that the draw cannot be conducted as planned for any reason, including those reasons beyond the control of Bernat, such as infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or corruption of the administration, security, fairness, integrity or proper conduct of this draw, the draw website, and/or www.bernatcares.com.

PRIVACY/USE OF PERSONAL INFORMATION:

Where permitted by law, entrant grants Bernat the right to: (a) use the organization’s information for the purpose of administering the contest; (b) use the organization’s name for publicity and promotional purposes without further compensation unless prohibited by law; and (c) use the organization’s name and its respective city and province or state of residence in connection with the draw website, other related websites and/or any other media now known or hereafter devised.

GENERAL TERMS AND CONDITIONS:

• Eligible entrants whose entry is selected as a potential winner are required to execute a Publicity Release (where permitted by law) and Release of Liability and Affidavit of Eligibility. The executed documents must be provided before the entrant is declared to be a winner and is entitled to receive the prize.
• By submitting an entry, the entrants agree to be bound by the Official Rules. These rules will be interpreted in Bernat’s sole discretion, and all determinations made pursuant to these rules by Bernat are final and binding.
• Bernat is not responsible or liable for entries that are lost, misdirected, delayed, destroyed, or lost in delivery.
• All entries become the exclusive property of Bernat. Entries will not be
  returned.
• All federal, state, provincial and local laws and regulations apply.
• Bernat reserves the right to terminate or suspend the contest or amend the contest and/or the contest rules in its sole discretion.
• Only one entry per charitable organization.
• CAUTION: ANY ATTEMPT BY A USER OR ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES
  IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

Acceptance of Terms. The bernatcares.com website ("the Website") is owned and operated by Spinrite LP (“Bernat”, “we” or “us”). These terms of use (the “Terms”) are a legally binding agreement between you (the “User” or “you”) and us. By using or accessing any part of the Website in any way including, but not limited to, becoming a member of the Website, posting a charity or posting a story or any other content on the Website, you signify that you have read, understand and agree to be bound by the Terms. Bernat reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject toindemnification by you hereunder, and you shall cooperate as fully as reasonably required by Bernat.

Monitoring Usage. Bernat, in its sole discretion, reserves the right to review, edit and/or remove any Submissions displayed or placed on the Website and/or the web server(s) hosting the Website and other websites owned by us. Misuse of the Website may result in civil and/or criminal liability. Bernat may immediately terminate the access of any User who misuses the Website or violates the Terms.
